Terms of Service

1. Who We Are

Viril Care ("Viril", "we", "us") operates a telehealth platform that may connect users with independent licensed healthcare providers and pharmacies. Unless explicitly stated otherwise, Viril is not a healthcare provider and does not itself provide medical care.

2. Not for Emergencies

The Services are not for medical emergencies. If you think you may have a medical emergency, call 911 immediately or go to the nearest emergency room.

3. Eligibility

You must be at least 18 years old and located in a jurisdiction where the Services are available to use the Services. You agree that information you provide is accurate and complete.

4. Telehealth and Clinical Services

If you seek clinical services through the platform, you may interact with independent licensed providers via asynchronous messaging, video, phone, or other telehealth modalities. Clinical decisions are made by the treating provider in their professional judgment.

5. Prescriptions, Pharmacy Fulfillment, and Products

• Prescription medications are available only if prescribed by a licensed provider.
• Prescriptions are filled and shipped (where permitted) by pharmacies that are responsible for dispensing and fulfillment.
• Some medications may be prescribed for off-label use or may be compounded where legally permitted. Compounded drugs are not FDA approved and may not be evaluated for safety, efficacy, or quality in the same way as FDA-approved drugs.
• You are responsible for following the provider's instructions and reading any medication labeling and pharmacy-provided information.

6. Accounts and Security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

7. Fees and Payments

You agree to pay all fees associated with your use of the Services, including any consultation fees, subscription fees (if offered), and prescription costs, as disclosed to you at the time of purchase. Taxes and shipping (if applicable) may be additional.

If you enroll in a subscription or auto-renewing plan, additional terms will be presented to you at sign-up and at checkout.

8. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes.
• Misrepresent your identity or submit false information.
• Interfere with or disrupt the Services, attempt to access accounts or systems without authorization, or probe our security.
• Copy, modify, distribute, sell, or lease any part of the Services unless permitted by law or by written agreement.

9. Intellectual Property

The Services and all related content, features, and functionality are owned by Viril or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not use our trademarks or content without permission.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRIL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VIRIL DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR OUTCOME WILL BE ACHIEVED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL VIRIL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRIL'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO VIRIL FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Viril and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your misuse of the Services or violation of these Terms.

14. Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms or if needed to protect the Services, users, or third parties.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent changes. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except to the extent such laws are preempted by or inconsistent with applicable law.
